Terms of Service

By signing up for the TrackThePack Commercial service ("Service") or any of the services of Sabotage Media, LLC, you are agreeing to be bound by the following terms and conditions ("Terms of Service"). Any new features or tools which are added to the current Service shall be also subject to the Terms of Service. Sabotage Media, LLC reserves the right to update and change the Terms of Service by posting updates and changes to the TrackThePack Commercial website. You are advised to check the Terms of Service from time to time for any updates or changes that may impact you.

Basic Terms

  1. You must be 18 years or older to use this site.
  2. You must provide a valid email address, and any other required information to complete the sign-up process.
  3. You are responsible for any activity that occurs under your account.
  4. You are responsible for keeping your password secure. Sabotage Media, LLC will not be liable for any loss or damage from your failure to maintain the security of your account and password.
  5. You must not abuse, harass, threaten, impersonate or intimidate other TrackThePack Commercial users.
  6. You may not use the TrackThePack Commercial service for any illegal or unauthorized purpose. International users agree to comply with all local laws regarding online conduct and acceptable content.
  7. You must not modify, adapt or hack TrackThePack Commercial or modify another website so as to falsely imply that it is associated with TrackThePack Commercial.
  8. You must not transmit any worms or viruses or any code of a destructive nature.
  9. You must not, in the use of TrackThePack Commercial, violate any laws in your jurisdiction (including but not limited to copyright laws).
  10. One person may not maintain more than one free account.

Violation of any of these agreements will result in the termination of your TrackThePack Commercial account. While TrackThePack Commercial prohibits such conduct and content on its site, you understand and agree that TrackThePack Commercial cannot be responsible for the Content posted on its web site and you nonetheless may be exposed to such materials and that you use the TrackThePack Commercial service at your own risk.

Payment of Fees

  1. A valid credit card is required for paying accounts. A credit card is not required to create or use a free account.
  2. We will charge you a standard monthly fee based on your account type. The Service is billed in advance for each month, and is non-refundable. There will be no refunds or credits for partial months of service, or refunds made should you not use the Service during a period of time when your account is open. No exceptions will be made.
  3. Should you upgrade or downgrade your account type, your credit card will be charged your new billing rate immediately. Your credit card will then be charged your new billing rate every 1 month thereafter unless you cancel your account.
  4. All fees are exclusive of all taxes or duties imposed by governing authorities. You alone are responsible for payment of all such taxes or duties.

Modifications to Services and Fees

  1. Sabotage Media, LLC reserves the right to modify, suspend, or discontinue the Service at any time for any reason with or without notice.
  2. Sabotage Media, LLC reserves the right to change our monthly fees upon 14 days notice from us. Fee change notices will be posted to the Service.

Cancellation and Termination

  1. You alone are responsible for the proper cancellation of your account. You may cancel your account at any time by clicking on the Account link in the Service's navigation menu. The Account screen provides a simple link to cancel your account. Email or phone requests to cancel your account will not be deemed valid cancellations.
  2. Upon cancellation of the Service, your account will be deactivated. We reserve the right to retain some of your Content for statistical purposes.
  3. You can cancel at any time, but you will remain liable for all charges accrued up to that time, including full monthly charges for the month which you discontinued service. You will not be charged again.
  4. Sabotage Media, LLC reserves the right to modify, suspend, or terminate your account at any time for any reason without notice or refund. We also reserve the right to delete all Content associated with your account. Sabotage Media, LLC may refuse service to anyone for any reason at any time.

Copyright and Ownership

  1. Sabotage Media, LLC or its suppliers own the intellectual property rights to any and all protectable components of the Service, including but not limited to the name of the Service, artwork and end-user interface elements contained within the Service, many of the individual features, and the related documentation. You may not copy, modify, adapt, reproduce, distribute, reverse engineer, decompile, or dissemble any aspect of the Service which Sabotage Media, LLC or its suppliers own.
  2. Sabotage Media, LLC claims no intellectual property rights over the Content you upload or provide to the Service. However, by using the Service to send Content, you agree that others may view and share your Content.

General Conditions

  1. We reserve the right to refuse service to anyone for any reason at any time.
  2. Your use of the Service is at your sole risk. The Service is provided on an "as is" and "as available" basis without any warranty or condition, express, implied or statutory.
  3. Sabotage Media, LLC does not warrant that the service will be uninterrupted, timely, secure, or error-free.
  4. Sabotage Media, LLC does not warrant that the results that may be obtained from the use of the service will be accurate or reliable.
  5. You understand that your Content (not including credit card information), may be transferred unencrypted and involve (a) transmissions over various networks; and (b) changes to conform and adapt to technical requirements of connecting networks or devices. Credit Card information is always encrypted during transfer over networks.
  6. We may, but have no obligation to, remove Content and Accounts containing Content that we determine in our sole discretion are unlawful, offensive, threatening, libelous, defamatory, pornographic, obscene or otherwise objectionable or violates any party’s intellectual property or these Terms of Service.
  7. You expressly understand and agree that Sabotage Media, LLC shall not be liable for any direct, indirect, incidental, special, consequential or exemplary damages, including but not limited to, damages for loss of profits, goodwill, use, data or other intangible losses resulting from the use of or inability to use the service.
  8. Technical support is only provided to paying account holders and is only available via email or the support forum.
  9. You agree not to reproduce, duplicate, copy, sell, resell or exploit any portion of the Service, use of the Service, or access to the Service without the express written permission by Sabotage Media, LLC.
  10. Verbal or written abuse of any kind (including threats of abuse or retribution) of any TrackThePack Commercial customer, Sabotage Media LLC employee, member, or officer will result in immediate account termination.
  11. The failure of Sabotage Media LLC to exercise or enforce any right or provision of the Terms of Service shall not constitute a waiver of such right or provision. The Terms of Service constitutes the entire agreement between you and Sabotage Media, LLC and govern your use of the Service, superseding any prior agreements between you and Sabotage Media, LLC (including, but not limited to, any prior versions of the Terms of Service).
